Where GDPR or UK GDPR applies, WildKard relies on the following legal bases: contract (to respond to and deliver on a service enquiry or agreement), consent (for newsletter and marketing emails, and for non-essential cookies), legitimate interests (for basic Site security and aggregated analytics, balanced against your rights), and legal obligation (for tax and accounting records).
WildKard does not sell personal information. We share information only with service providers who process data on our behalf, grouped by category below. The current list of specific tools in each category is maintained in Appendix A at the end of this Policy, which we update as tools change without needing to rewrite this Policy in full.
WildKard’s client service agreements should confirm which subprocessors touch client data for each engagement, and should include a Data Processing Addendum for any client requesting one, common for EU/UK-based clients.
WildKard is based in Ohio, United States. If you are accessing the Site from the UK, EU, Australia, New Zealand, or Canada, your information will be transferred to and processed in the United States, where data protection laws differ from those in your jurisdiction. Google Analytics is certified under the EU-US Data Privacy Framework, which is a recognized transfer mechanism under GDPR and UK GDPR.
For visitors in Canada, marketing emails are sent only with your express opt-in consent, in line with Canada’s Anti-Spam Legislation (CASL), and every email identifies WildKard and includes a working unsubscribe mechanism. For visitors in the EU, UK, and Australia, the same opt-in standard applies. Newsletter sign-up forms use an active, unchecked opt-in box rather than a pre-checked default. You may withdraw consent and unsubscribe at any time using the link in every email or by contacting us directly.
Forward note: when an email marketing platform is selected (e.g. Mailchimp, ConvertKit, GetResponse), it must support double opt-in for CASL/GDPR purposes, log the timestamp and method of consent for each contact, and offer an EU-US Data Privacy Framework certification or equivalent transfer mechanism. Update Appendix A and the bullet list in Section 4 once selected, no other change to this Policy should be needed.
Forward note: if social media advertising or retargeting is added later (e.g. a Meta Pixel or LinkedIn Insight Tag placed on the Site), this is a materially different situation from scheduling tools, since the platform itself may become a joint controller of visitor data under GDPR. This requires a specific disclosure update, a new consent banner category, and counsel’s review before the pixel goes live, not just an Appendix A update.
